These Terms and Conditions of Use (“Terms”) constitute a binding legal agreement between you (“User” or “you”) and ENV Athletics, a division of Syzzle Holdings LLC, a Michigan limited liability company (“ENV Athletics,” “we,” “us,” or “our”), governing your access to and use of this website and any related services, platforms, or applications (collectively, the “Site”).

BY ACCESSING, BROWSING, OR OTHERWISE USING THE SITE, YOU ACKNOWLEDGE THAT YOU HAVE READ, UNDERSTOOD, AND AGREE TO BE BOUND BY THESE TERMS. IF YOU DO NOT AGREE TO THESE TERMS IN THEIR ENTIRETY, YOU MAY NOT ACCESS OR USE THE SITE.

1. Eligibility and Capacity

Use of this Site is limited to persons who have the legal capacity to enter into a binding contract under applicable law. By accessing this Site, you represent and warrant that you are at least eighteen (18) years of age or the legal age of majority in your jurisdiction of residence, and possess the legal right and authority to enter into these Terms on your behalf.

2. Intellectual Property Rights

All text, graphics, logos, icons, images, audio clips, data compilations, software, and other content, including the arrangement thereof (collectively, the “Content”), are the exclusive property of ENV Athletics or its licensors, and are protected under applicable intellectual property laws, including copyright, trademark, and trade dress laws.

You are granted a limited, revocable, non-exclusive, non-transferable license to access and use the Site for personal, non-commercial use only. No license is granted to modify, distribute, reproduce, display, or create derivative works from the Content, unless expressly authorized in writing by ENV Athletics.

3. User Submissions

If you submit any content to the Site, including but not limited to reviews, feedback, images, or suggestions (“User Submissions”), you hereby grant ENV Athletics a perpetual, irrevocable, royalty-free, fully paid, worldwide, non-exclusive license to use, copy, modify, distribute, display, and perform such submissions in connection with its business operations.

You represent and warrant that:
(a) you own or have the necessary rights to submit the User Submissions; and
(b) such submissions do not infringe or violate the intellectual property, privacy, or other legal rights of any third party.

4. Product Availability and Pricing

All prices displayed on the Site are quoted in U.S. Dollars and are subject to change without notice. Product availability is not guaranteed and may be subject to manufacturing or supplier constraints, including third-party vendors such as Printify.

ENV Athletics reserves the right to cancel or refuse any order, including for errors in pricing, inventory availability, or suspected fraud, at its sole discretion.

5. Shipping, Returns, and Refunds

ENV Athletics ships products via third-party fulfillment providers. Orders may be subject to delays beyond our control.

Returns are accepted within thirty (30) calendar days from the date of delivery, subject to the following conditions:

  • Items must be unworn, unwashed, and in original packaging.

  • Return shipping shall be borne by the customer unless the product was defective, damaged, or incorrect.

  • Refunds, if applicable, shall be issued to the original form of payment within a reasonable period, not to exceed five (5) business days from receipt of returned merchandise.

6. Prohibited Conduct

You agree that you shall not:

  • Use the Site for unlawful, fraudulent, or harmful purposes;

  • Interfere with or disrupt the operation of the Site or its servers;

  • Attempt to gain unauthorized access to any portion of the Site or other accounts, systems, or networks;

  • Impersonate any person or entity or misrepresent your affiliation with any entity;

  • Use automated systems (e.g., bots, crawlers) to access the Site without express written permission.

7. Disclaimer of Warranties

THE SITE, ITS CONTENT, AND ALL PRODUCTS AND SERVICES MADE AVAILABLE THROUGH THE SITE ARE PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS WITHOUT ANY WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, ENV ATHLETICS DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL ENV ATHLETICS, ITS OWNERS, OFFICERS, EMPLOYEES, AGENTS, AFFILIATES, OR LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, EXEMPLARY, OR PUNITIVE DAMAGES ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SITE OR PRODUCTS PURCHASED THEREFROM, WHETHER BASED IN CONTRACT, TORT (INCLUDING NEGLIGENCE), STRICT LIABILITY, OR OTHERWISE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

THE TOTAL LIABILITY OF ENV ATHLETICS FOR ANY CLAIM ARISING OUT OF OR RELATING TO THESE TERMS SHALL NOT EXCEED THE AMOUNT PAID BY YOU FOR THE PRODUCT OR SERVICE GIVING RISE TO THE CLAIM.

9. Indemnification

You agree to indemnify, defend, and hold harmless ENV Athletics and its affiliates, officers, directors, employees, and agents from and against any and all claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys’ fees) arising from or in any way related to your use of the Site, your User Submissions, or your violation of these Terms.

 

10. Modifications

ENV Athletics reserves the right to update or modify these Terms at any time without prior notice. Any such changes shall become effective immediately upon posting. Your continued use of the Site after such changes constitutes your binding acceptance of the revised Terms.

11. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of the State of Michigan, without regard to its conflict of law principles. Any dispute arising under or related in any way to these Terms shall be adjudicated exclusively in the state or federal courts located in Wayne County, Michigan, and you consent to the jurisdiction of such courts.

12. Severability

If any provision of these Terms is held to be unlawful, void, or for any reason unenforceable, then that provision shall be deemed severable from these Terms and shall not affect the validity and enforceability of the remaining provisions.
